Since 6 April 2026, the agency contracting with the end client can be jointly liable for PAYE tax and National Insurance due on workers supplied through an umbrella company.

IR35 responsibilities depend on the end client and contractual chain — the end client usually determines status, while an agency may be responsible for operating PAYE. Different rules apply to small private-sector clients.
